Although the new regulations reduce the amount of paperwork, they can initially create uncertainty about what needs to be done before building a house up to 70m². Fortunately, it's not as difficult as it seems – there's not much to worry about, and you just need to familiarize yourself with the current requirements. We'll discuss that in this article.

The year 2022 brought significant changes to the Construction Law, abolishing the requirement to obtain a building permit for homes up to 70m². And this isn't the end of the revolution, as further improvements are planned for next year, including the extension of these permits to all single-family homes without a floor area limit.

Does this mean there are no formalities required? Not entirely. The procedure for building single-family homes has been simplified, but there are still a few documents to be completed.

Here's what you need to do before building a house up to 70m2:

Selection and purchase of a plot

To begin construction, you need a building plot. Choosing a plot should be carefully considered, so don't rely solely on the price. Consider location and size first. If you already have your dream house design in mind, make sure it's feasible to build on the plot. Legally, the plot size doesn't matter much – the only restriction is that you can build one building of up to 70 m² for every 500 m² of land.

Local development plan.

If such a plan has not been adopted for your plot, you must apply for a municipal decision on development and land use conditions. New regulations have shortened the waiting time for this document to 21 days. To obtain these documents, you must submit an application to the city or municipal office and pay a stamp duty.

Report to the starosta or city president.

  • The application must be submitted along with the construction design. To do this, you must complete the required documents:
  • architectural and construction design, consistent with the development plan or decision on development conditions,
  • land development plan,
  • spatial development plan or decision on development conditions,
  • declaration of the right to dispose of the plot,
  • a declaration of construction to meet one's own housing needs,
  • a statement of assumption of responsibility for construction management (if you do not wish to employ a construction manager),
  • declaration of submission of complete documentation.
